Trust Administration


If a decedent drafted and funded a Revocable Living Trust then upon their death there probably will not be a probate administration. The decedent names a Successor Trustee in their Trust to administer the Trust based on the terms of their Trust. The Successor Trustee has similar duties as a Personal Representative, such as identifying the decedents debts, handling those debts, locating Trust assets, usually liquidating those assets, and then distributing assets to the beneficiaries based on the terms of the Trust. The Successor Trustee needs to locate and review all of the decedents estate planning documents as well as locate all of the beneficiaries. The Successor Trustee needs to fill the original Will with the local Probate Court and record the death certificate in the County where the decedent lived and/or owned real property.
